Today's litigious society has made asset protection a concern for everyone. Even those with currently modest means may be at risk, due to long term wealth accumulation potential from income production or other sources.
The attorneys in our Trusts & Estates Group typically address asset protection planning in coordination with our clients' estate planning. We use the protections provided by Florida law to create significant and economical solutions for our clients.
Our asset protection planning work is performed taking into consideration Florida's fraudulent transfer and fraudulent conversion laws, which prohibit structuring asset ownership with an intent to hinder, delay, or defraud creditors. In most cases, we find our clients can protect their assets adequately utilizing the mainstream protections available under Florida law, and thereby avoid the use of riskier strategies.
