Overview

Our group assists clients during the federal examination of retirement plans and applicable annual filings.

With the Internal Revenue Service (IRS) and the Department of Labor (DOL) escalating their focus on this area, our attorneys are prepared to walk clients through all aspects of these examinations. We gather and organize appropriate documentation, identify matters that may become relevant during the examination, represent the client's interests during the examination, and negotiate with the regulatory agency.

We are also knowledgeable in the voluntary corrections programs offered by both the IRS and DOL. These voluntary programs are designed to assist plan administrators and fiduciaries in identifying and correcting plan compliance issues before the issue is discovered during a regulatory audit, in order to avoid excessive penalties. We can provide advice on the most cost-effective method to correct a compliance failure under the appropriate IRS or DOL program. Finally, in the event that an issue requires a formal filing with either the IRS or the DOL, we will complete the filing and obtain the appropriate relief.
