Alternative Dispute Resolution

Overview

Disputes are a normal part of doing business. Resolving them doesn’t have to be costly, time-consuming, or disruptive, as litigation often is. Our Alternative Dispute Resolution practice helps parties resolve disputes efficiently, fairly, and practically before litigation begins, or to bring ongoing litigation to a conclusion.

Some of our attorneys serve as mediators, others as arbitrators, and some act in both capacities.

Mediation

Mediation is a structured yet flexible process that helps parties resolve their differences outside of court. We guide discussions, keep negotiations productive, and help both sides explore solutions they may not have considered. In many cases, mediation not only resolves the dispute but also preserves important business or personal relationships.

All attorneys in our Mediation Group are certified by the Florida Supreme Court as Circuit Court Mediators. When we serve as mediators, our role is straightforward: we help parties identify, evaluate, and agree on a resolution. We do not take sides or advocate for any party.

Experienced Guidance That Adds Value

Our mediators bring decades of complex litigation experience to the table. They regularly handle – and have deep insight into – the types of disputes they mediate, including:

  • Business and commercial disputes
  • Construction
  • Insurance coverage matters, including life, health, disability, and ERISA claims
  • Legal malpractice and other professional liability claims
  • Personal injury matters, including medical malpractice, wrongful death, product liability, auto and trucking accidents, and nursing home liability
  • Real estate litigation

This background allows our mediators to take an active, hands-on approach. They help move negotiations forward by:

  • Asking targeted questions
  • Clarifying risks and options
  • Identifying obstacles and ways to overcome them
  • Offering practical, creative settlement ideas

Arbitration

Arbitration is a private, legally binding process in which one or more neutral arbitrators resolve a dispute. It is typically more efficient, cost-effective, and confidential than traditional litigation. Parties also have a meaningful role in selecting the arbitrator(s) who will decide their case.

Our Arbitration Group includes attorneys who serve on the American Arbitration Association (AAA) Panel and who have acted as arbitrators in hundreds of complex construction, commercial, and consumer disputes. They also serve in non-binding arbitration proceedings, which are increasingly a feature of state court litigation.
