Jason L. Molder - Senior Counsel

Jason is Senior Counsel at Hill Ward Henderson, where he is a member of the Construction & Design Law, Digital Accessibility, and Intellectual Property & Technology Law groups, and leads the E-Discovery & Information Governance group.  He focuses his practice on construction and design contracts, electronic discovery, digital accessibility, and select areas of information technology law.  Jason graduated cum laude in 2002 from the University of Miami School of Law, and has a Bachelor of Arts degree in Social Psychology from Florida Atlantic University.

Jason has experience in almost all areas of construction law and litigation, and has represented public and private owners, sureties, contractors, construction managers, design-builders, and subcontractors in both litigation and arbitration proceedings, and in connection with the negotiation and drafting of construction and design agreements.  He has handled complex construction disputes including condominium defect, indoor air quality (including mold and asbestos) and HVAC, performance and payment bond (including Miller Act), delay, and defect claims.  His contract experience includes the negotiation and drafting of commercial, industrial, and residential construction, construction management, design, design-build, and EPC agreements, with extensive experience using the American Institute of Architects family of construction documents.

Prior to attending law school, Jason was an assistant network engineer for a major public university, and served in a technical support capacity for both an internet service provider and a healthcare company.  As a result, Jason gained experience in internet technology, network engineering, network security, and client/server systems.  Jason stays current on IT industry developments and offers legal representation on matters involving digital accessibility, software licensing, end user license agreements, data privacy and security, data policies, procedures, and protocols, technology contracts, and other areas of information technology law.

Jason also maintains an active e-discovery practice, and advises clients in the areas of policy development, litigation readiness, legal holds, vendor selection, early case assessments, the collection, processing, search, review, and production of electronically stored information (ESI), and e-discovery risk assessments.  Jason further stands ready to assist other law firms as outside e-discovery co-counsel, at both the pre-trial and trial stages, in all areas involving ESI, including e-discovery motion practice.  On the consulting side, Jason offers e-discovery and technology consulting services, and can assist in areas such as bringing e-discovery in-house, software selection, project management, protocol and procedure development, and more.

Jason is admitted to practice law in the States of Florida and Tennessee.

Jason also serves on the firm’s COVID-19 Response Team for the construction industry.
