Hill Ward Henderson Launches ADA Accessibility Practice Group

Hill Ward Henderson has assembled a team of attorneys and consulting experts equipped to guide clients in identifying and correcting noncompliant websites and in responding to demand letters and lawsuits based on website ADA claims.

The ADA Accessibility Practice Group led by Robert “Bob” M. Fulton, Jason L. Molder and William “Bill” J. Judge, Jr., was created to address the Americans with Disabilities Act (ADA), which prohibits discrimination based upon disability in places of public accommodation. Recent caselaw has held that websites inaccessible to those with disabilities (such as persons with low vision, blindness, etc.) violate the nondiscrimination provisions of the ADA. “With eleven categories defining what constitutes a ‘place of public accommodation,’ almost all businesses with brick-and-mortar locations (and possibly even some without) could potentially be affected by digital accessibility concerns,” said Bill Judge, shareholder and co-chair of the firm’s Cybersecurity, Data Breach and Protection practice group. “With varying Court opinions and no clear regulations, business owners can easily be caught off guard with an inaccessible website,” Judge added.
